今回のニュースを聞いて驚きましたが，その後の対応としてまず組織の上層部の人が会見を開いて謝罪したことに違和感を持ちました．「研究の責任者は誰であるのか」を考える際に，研究業界の人とそうでない人で，考え方や感じ方の様々な前提が違っていると思います．ですから「研究業界にいないと知られてなさそうなこと」を書きたいと思います．私は大学で工学系の研究室を運営する立場ですが，大学と研究所では組織の構造が違うものの，研究室のあり方については共通部分も多いという仮定で書いています．事実誤認があるなら教えて下さい．
ちなみに学生と研究員からなる理学系・工学系の研究室を念頭においています．社会科学，人文科学だと少し勝手が違うかもしれません．これについても違いや事実誤認があれば知りたいです．
１．「大学」と「研究室」の関係
大学にはいくつもの研究室が所属しています．「所属している」とはどういうことかというと，そこに研究室（ラボとか研究チームと呼ぶこともあります）があって，所属する大学が提供するリソースを使っている，ということです．
私は大学に雇われて（主に）授業と研究を仕事にして給料をもらっています．そして研究をするために，外部からの研究費を取ってきて「間接経費」として大学に納めています．この「間接経費」によって，大学の設備を使わせてもらったり（場所・電気・ガス），人を雇う際の書類作業をしてもらったり，研究資金や特許に応募する際の書類作業を手伝ってもらいます（事務書類作業）．良い研究結果が出ればプレスリリースを準備してくれたり（広報），著名な大学に所属していれば，社会的な認知と信頼に繋がることもあります（ブランド・クレディビリティ）．これらの研究室運営に必要な様々な機能を「間接経費」を支払うことで使わせてもらっている，というのが大学と研究室の中の人との関係です．
これはどういうことかというと，大学に所属するというのは「授業をする」という立場では雇用者・被雇用者の関係なのですが，「研究をする」立場においては必ずしもその限りでないということです．こちらからお金を払って研究室の運営のリソースを得ている関係です．喩えるならば，ベンチャー企業がお金を払ってコワーキングスペースとかシェアオフィスを使ってるとか，デパートとテナントの関係が近いかもしれません．
そういった「独立した研究室」の集合が研究組織としての大学です．その中で「それらの研究室を統括する機能があるのか」という質問に対しては，教授会などの自治的な委員会はあります．しかしそれは各研究室の運営の方針についてまで口を出すような存在ではありません（少なくとも私の所属大学ではそうです）．つまり「独立した研究室」に対して，監督責任を持っている上位の主体はありません．これが大学でなく研究所だと，どのような関係なのかは明確にはわかりませんが，私の見聞きした感じだと，各研究室の独立性はある程度保証されているという理解です．
以上の前提が，研究をしていない人にはあまり共有されていないように思いました．率直に言えば，今回の不正に対して，まず論文不正に関わった研究者本人が出てこずに，研究所や大学の偉い人が謝罪したことの理由がわかりませんでした．独立した研究室は研究計画と実施に於いて全ての自由度を持っており，研究所ぐるみで不正を行う可能性は限りなく低いと思うからです．
２．論文の責任者
次に発表論文に不正があったら誰が責任を取るのかについてです．論文には著者がいて，著者はその研究に関わった人です．ですから何か問題があれば，著者が責任を持ちます．著者の中でも corresponding author という立場の著者がいて，その人がその論文を統括した最高責任者です．
以上が過不足のない説明です．研究所の所長も大学の学長も，今回疑義があった論文の著者ではありませんので，これも謝罪した主体に疑問を感じた理由です．
余談ながら研究論文と企業の製品は性質が違うものです．A 社が出した携帯電話に不具合があれば A 社が責任を持つのが社会通念上適切だと思いますが，論文については著者が所属している大学や研究機関が責任を持つものではありません．繰り返しになりますが，その論文の方針と内容を決める全権は，研究室の主宰者と corresponding author が持っているからです．ただこのような違いは研究をしていないと馴染みがなさそうなので，組織の長が謝罪した方がおさまり良く感じる人が多い理由なのかもしれないと思いました．
３．謝罪と責任
以上長くなりましたが，このような話を共有して，現場の研究者の考え方が理解されたらと思いました．組織の上層部の人が謝罪して「組織として研究不正を止められなかったことに対する責任がある」というのは綺麗ですが，独立した研究室の集合体である大学とか研究所において実情を反映しているのか，「組織として研究不正を止める」というのが可能なのか，疑問でもあります．
少し話がずれますが，日本人はよく謝ると思うのですが，自分が責任を持ってないことに謝ると，責任の所在が曖昧になります．とりあえず謝るのは日本のローカルルールです．今回のように山中先生が頭を下げて謝罪をしている写真が切り取られると，日本国外の少なからぬ文化圏では，山中先生が不正を主導したから謝罪していると受け取られそうです．何とも悲しいことです．
最後に，本件は自分の名前を出して研究をしているという矜持の問題でもあります．研究者は自分の名前で何かを成し遂げたい人が多くて，組織に研究室のあり方を決められるとか，研究のやり方を決められるという考え方とは相容れない人が多そうです．なかなか気難しい面々ということでもあるのですが，だからこそ私は研究者や，自分の名前で会社をやってるような人が好きで応援しています．そして論文を発表する際には自分の名前が出て，それがどんなに小さいものでも達成感があります．その時に得られる名誉と責任は裏表ですから，名誉に見合った責任を負いたいです．責任を負えるのは名誉なことです．最後はただの感想になりました．
